TERMS AND CONDITIONS OF SALE

Last updated: [DATE]

These Terms and Conditions of Sale govern purchases made through ticocobokitclub.com (the “Website”).

The Website and the Ti Coco Bokit Club brand are owned and operated by:

BEWEIRD
[LEGAL FORM], with a share capital of EUR [SHARE CAPITAL]
Registered office: [FULL REGISTERED ADDRESS]
French business registration number: [SIREN]
Trade and Companies Register of [CITY]: [RCS NUMBER]
EU VAT number: [VAT NUMBER]
Email: [CUSTOMER SERVICE EMAIL]
Telephone: [TELEPHONE NUMBER]

Beweird is referred to below as “Ti Coco,” “we,” “us” or “our.”

1. SCOPE

These Terms apply to all orders placed through the Website for products offered under the Ti Coco Bokit Club brand, including clothing, accessories, merchandise, packaged food products, sauces and other goods displayed online.

They do not apply to meals, beverages or services purchased directly at a Ti Coco Bokit Club restaurant, pop-up, event or third-party location unless expressly stated otherwise.

By placing an order, the customer confirms that they have read and accepted these Terms before completing the purchase.

2. CUSTOMER ELIGIBILITY

Customers must have the legal capacity to enter into a contract.

If a customer is under the age of legal majority in their country or state of residence, the order must be placed or approved by a parent or legal guardian.

The Website does not currently offer alcoholic beverages for online sale unless expressly stated on the relevant product page. Any future sale of age-restricted products will be subject to additional age-verification requirements.

3. PRODUCTS

The essential characteristics of each product are described on the relevant product page.

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colors and prices are accurate. However:

  • colors may vary depending on the customer’s screen;

  • handmade or printed products may present minor variations;

  • product packaging may change without affecting the product’s essential characteristics;

  • photographs are provided for illustrative purposes and are not contractually binding where minor variations exist.

Customers should review the product description, size information, ingredients, allergens and care instructions before ordering.

4. FOOD PRODUCTS AND ALLERGENS

Packaged food products may contain or have been produced in facilities handling allergens, including gluten, eggs, milk, peanuts, tree nuts, soy, sesame, fish, shellfish, mustard or other allergens.

The applicable ingredients and allergen information are displayed on the product page or packaging.

Customers with allergies or dietary restrictions must review this information carefully before purchasing or consuming a product. If information appears incomplete, the customer should contact us before placing an order.

Food products must be stored and used in accordance with the instructions provided on their packaging.

5. PRODUCT AVAILABILITY

Products are offered subject to availability.

Adding a product to a shopping bag does not reserve it. A product may become unavailable before checkout is completed.

If a product becomes unavailable after an order has been placed, we will notify the customer and either:

  • offer a suitable replacement, subject to the customer’s approval;

  • issue a refund for the unavailable product; or

  • cancel and refund the affected order.

6. PRICES

Prices are displayed in the currency selected or indicated on the Website.

Unless stated otherwise, prices include taxes required to be collected at the time of purchase. Shipping costs, import duties, customs charges and other applicable fees may be added before the order is confirmed.

The total amount payable is displayed during checkout before the customer submits the order.

We may change our prices at any time. The price charged is the price displayed when the order is submitted, except in the event of an obvious pricing or technical error.

7. ORDERS

To place an order, the customer must:

  1. select the desired products and options;

  2. add them to the shopping bag;

  3. review the shopping bag;

  4. provide accurate billing, shipping and contact information;

  5. select an available delivery and payment method;

  6. review the final price;

  7. accept these Terms; and

  8. submit payment.

The customer is responsible for checking the accuracy of all order information before submitting the order.

An automated acknowledgement email confirms that we have received the order. It does not necessarily mean that the order has been accepted.

The sale is considered final when payment has been authorized and we send an order confirmation or dispatch confirmation, subject to applicable consumer law.

8. ORDER REFUSAL OR CANCELLATION

We reserve the right to refuse or cancel an order for legitimate reasons, including:

  • product unavailability;

  • payment refusal or suspected fraud;

  • inaccurate or incomplete customer information;

  • an obvious pricing or product-description error;

  • an order placed in breach of these Terms;

  • unusual quantities suggesting unauthorized resale;

  • legal, regulatory or delivery restrictions.

If we cancel an order after payment has been collected, the corresponding amount will be refunded using the original payment method.

9. PREORDERS AND LIMITED DROPS

Certain products may be offered as preorders, limited editions or small-batch drops.

The estimated production or dispatch date will be displayed on the product page. These dates are estimates and may change due to production or logistics constraints.

If an order contains both available and preorder items, the entire order may be shipped together when all products are available unless split shipping is offered.

Material delays will be communicated to the customer. Any cancellation or refund rights required by applicable law remain unaffected.

10. PAYMENT

Available payment methods are displayed during checkout and may include credit or debit cards and payment services offered through Shopify or third-party payment providers.

Payment is due in full when the order is placed unless an installment option is expressly offered.

Payment information is processed securely by Shopify and the selected payment providers. Beweird does not receive or store complete payment card details.

The customer confirms that they are authorized to use the selected payment method.

11. DELIVERY

We deliver to the countries and territories available during checkout.

Available delivery methods, estimated delivery times and shipping costs are displayed before the order is submitted.

Orders are delivered to the address provided by the customer. The customer is responsible for ensuring that this information is complete and accurate.

Estimated delivery times begin once the order has been dispatched, not when the order is placed.

Delivery times may be affected by circumstances beyond our reasonable control, including customs procedures, carrier disruption, adverse weather, strikes, public holidays or force majeure events.

We are not responsible for delays caused by inaccurate or incomplete delivery information supplied by the customer.

12. CUSTOMS, DUTIES AND IMPORT TAXES

For international orders, customs duties, import taxes, brokerage fees or local charges may apply.

Unless checkout expressly states that these charges are included, they are payable by the customer upon importation.

Customers are responsible for checking the import rules applicable in their country, particularly for food products.

If a parcel is refused because the customer does not pay applicable customs charges, any refund may be reduced by the shipping, return and administrative costs incurred, to the extent permitted by law.

13. DELIVERY ISSUES

The customer should inspect the parcel promptly after delivery.

If a parcel is damaged, incomplete, lost or marked as delivered but has not been received, the customer should contact us as soon as possible at:

[CUSTOMER SERVICE EMAIL]

The message should include:

  • the order number;

  • the customer’s full name;

  • a description of the issue;

  • photographs of the parcel and products, where relevant; and

  • any supporting information requested by the carrier.

Nothing in this section limits the customer’s statutory rights.

14. RIGHT OF WITHDRAWAL FOR EU AND UK CONSUMERS

Where applicable, consumers residing in the European Union or the United Kingdom may withdraw from an eligible distance purchase within 14 days without giving a reason.

The withdrawal period generally begins on the day the consumer, or a third party designated by the consumer, receives the product.

To exercise this right, the customer must send a clear withdrawal request before the deadline to:

[WITHDRAWAL EMAIL]
[POSTAL ADDRESS]

The customer may use the withdrawal form provided at the end of these Terms, but this is not mandatory.

The customer must return the products within 14 days after notifying us of the withdrawal.

Unless otherwise required by law, the customer is responsible for the direct cost of returning the products.

15. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal may not apply to:

  • products made to the customer’s specifications or clearly personalized;

  • products liable to deteriorate or expire rapidly;

  • sealed products that are not suitable for return for health-protection or hygiene reasons once unsealed;

  • sealed food products that have been opened;

  • products inseparably mixed with other items after delivery;

  • any other product excluded under applicable law.

These exceptions do not affect rights relating to products that are defective, damaged or not as described.

16. VOLUNTARY RETURNS

In addition to any mandatory legal rights, we accept eligible returns requested within [NUMBER] days after delivery, subject to the conditions below.

Returned products must be:

  • unworn, unused and unwashed;

  • complete and undamaged;

  • returned with their original tags and packaging;

  • free from odors, stains, hair or signs of use;

  • accompanied by proof of purchase.

Food products, sauces, cosmetics, underwear, socks and hygiene-sensitive products cannot be returned once opened or unsealed, unless they are defective or damaged.

Before returning a product, the customer must contact:

[RETURNS EMAIL]

Returns must be sent to:

[RETURNS ADDRESS]

Products must not be returned to Shopify.

Unauthorized returns may be refused or delayed.

17. RETURN SHIPPING COSTS

Unless the product is defective, damaged, incorrect or otherwise covered by a mandatory legal guarantee, return shipping costs are paid by the customer.

We recommend using a tracked return service. The customer remains responsible for the parcel until it is received at the designated return address.

Original express-delivery surcharges are not refundable unless required by law.

18. REFUNDS

Once a return has been received and inspected, we will notify the customer whether the refund has been approved.

Approved refunds are issued to the original payment method within [NUMBER] business days. The customer’s bank or payment provider may require additional processing time.

We may reduce a refund to reflect any loss in value caused by handling beyond what is reasonably necessary to inspect the product, where permitted by law.

Shipping charges are refunded only where required by applicable law or expressly stated in our return policy.

19. EXCHANGES

We do not guarantee direct exchanges.

Where exchanges are unavailable, the customer should return the eligible product and place a new order.

Replacement products remain subject to availability.

20. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If a product is defective, damaged on arrival or different from the product ordered, the customer should contact us promptly at:

[CUSTOMER SERVICE EMAIL]

The customer should provide the order number and clear photographs showing the issue.

Depending on the circumstances and applicable law, we may offer:

  • a replacement;

  • a repair;

  • a price reduction; or

  • a full or partial refund.

The customer’s statutory legal guarantees remain fully applicable.

21. LEGAL GUARANTEES

Consumers benefit from all mandatory legal guarantees applicable in their country of residence.

For consumers residing in France or elsewhere in the European Union, these rights may include the statutory guarantee of conformity and protection against hidden defects.

Nothing in these Terms excludes, restricts or replaces rights that cannot legally be waived.

22. PROMOTIONAL CODES

Promotional codes:

  • must be used before their stated expiration date;

  • apply only to eligible products and orders;

  • cannot be exchanged for cash;

  • cannot be applied retroactively;

  • cannot be combined unless expressly stated otherwise.

We may refuse or cancel a promotional code used fraudulently, unlawfully or contrary to its stated conditions.

23. GIFT CARDS

If gift cards are offered, their validity period, territorial restrictions and conditions of use will be displayed at the time of purchase.

Gift cards cannot be redeemed for cash except where required by law.

The customer is responsible for safeguarding the gift-card code.

24. CUSTOMER ACCOUNTS

Customers may be able to create an account to track orders and manage personal information.

Customers are responsible for maintaining the confidentiality of their login credentials and for activity conducted through their account.

Suspected unauthorized account use should be reported immediately to:

[CUSTOMER SERVICE EMAIL]

We may suspend or close accounts used fraudulently or in breach of these Terms.

25. INTELLECTUAL PROPERTY

The Website, the Ti Coco Bokit Club brand, logos, product designs, photographs, graphics, texts, packaging, menus and other content are protected by intellectual property laws.

Purchasing a product does not grant the customer any right to reproduce, distribute, commercially exploit or create derivative works from the brand or its content.

Products may not be purchased for unauthorized resale, reproduction or promotional use.

26. PERSONAL INFORMATION

Personal information collected in connection with orders is processed in accordance with our Privacy Policy.

Shopify and payment, shipping, analytics or customer-service providers may process information as necessary to operate the Website and fulfill orders.

Customers should review the Privacy Policy for information about processing purposes, legal grounds, retention periods and privacy rights.

27. FORCE MAJEURE

We will not be liable for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, strikes, transportation disruption, government action, utility failure, cyber incidents or supply-chain interruption.

If such an event materially affects an order, we will contact the customer and take reasonable steps to minimize the impact.

Mandatory consumer rights remain unaffected.

28. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Beweird is not liable for indirect, incidental or consequential loss arising from the purchase or use of products.

Nothing in these Terms excludes or limits liability for:

  • fraud or fraudulent misrepresentation;

  • death or personal injury caused by negligence;

  • gross negligence or willful misconduct;

  • defective products where liability cannot be excluded;

  • breach of mandatory consumer rights; or

  • any other liability that cannot legally be excluded.

31. GOVERNING LAW AND JURISDICTION

Any dispute should first be submitted to our customer service team in an attempt to reach an amicable resolution.
